Summer Recreation Program:
LMPHOA provides a summer recreation program that varies somewhat from year
to year based on community interests and resources. At a minimum, the
Association is committed to providing lifeguard coverage through most of the
summer season. Typically, the season begins in mid- June with staff services
on weekends only and with weekday staffing being added in July. Mid-August,
services again drop back to weekends only until the season ends on Labor
Day. Lifeguard hours are 11-6 p.m. unless otherwise posted. In addition, the
Snack Shack provides food items for sale and the Equipment Shed is open for
the rental of: boats, sports equipment, and beach toys. Outside bathrooms
are available during lifeguard hours. The Fourth of July is celebrated
annually at dark with fireworks under special permit from the fire
department (please be aware fireworks are not allowed off site due to the
high fire danger). LMPHOA staff may in addition provide recreational
activities as indicated in the Summer Recreation Calendar or as posted on
the bulletin board at the lake. Community members are encouraged to call the
office if they have a specific talent or activity they are interested in
leading or organizing. The Summer Program is under the supervision of the
Board and activities are always subject to staff availability.
Common Area Use:
LMPHOA common area includes the
lake, beach, lodge, grounds surrounding the lodge, dam, and path around the
lake. Owners and their guests are welcome to use these areas with the
understanding that they follow the rules as specified and are respectful of
the rights of nearby property owners. Participating in work days is a great
way to learn about the association, meet neighbors, and help with the upkeep
of these areas. Requests for group use of the picnic area must be arranged
through the Office.
After hours/Off season
Use: Owners and their
guests using the facilities without staff supervision need to know and
follow the LMPHOA rules. A responsible caretaker should supervise children
and non-swimmers at all times. If approached by LMPHOA staff or a Board
member, user should be prepared to identify themselves and be in possession
of a LMP tag as well as their guests. After hours group use should be
cleared through the office.
Children:
A responsible caretaker or adult
who is actively providing supervision must accompany all children under 11.
Parents are responsible for the behavior and safety of their children. Older
children with behavior problems that continually distract the lifeguards may
be required to be accompanied by an adult when at the lake. Please be aware
that the County curfew for minors is 10:30p.m. (LMPHOA uses a 10p.m. curfew
to facilitate children's arrival home on time.) After 7PM no minors are
allowed without adult supervision.
Behavior:
LMPHOA is committed to maintaining a family friendly atmosphere. Staff,
members, and guests are expected to behave in a respectful manner towards
one another. Specifically, this means acts of physical aggression, verbal
abuse, name calling, sexual harassment, possession of weapons (including bb
guns, sling shots, fireworks etc.) are not allowed. Public intoxication or
drug use is strictly prohibited and may result in a call to law enforcement
in addition to exclusion from the facilities. Property owners will be held
responsible financially for the destruction or vandalism of any property,
including any caused by their children or guests.
Trash:
Owners and their guests are
expected to clean up after themselves and place trash in the appropriate
receptacle. Recycling containers are labeled and available by the lodge.
The Avery Refuse Station is open
to the public. Hours are Friday through Tuesdays 9 am to 5:30 pm.
Smoking:
Smoking by adults is permitted in
the designated area only. Please place all cigarette butts in containers
designated for this purpose. Butts should never be tossed on the ground due
to the high fire danger in addition to the prohibition against littering.
Noise:
Personal stereos may be brought to
the lake but need to be kept at a low volume or used with headphones. Please
respect your neighbor's wishes if they ask you to turn the volume down or
move to another area.
Pets:
No pets of any kind are allowed in the Beach Area due to hygiene concerns.
Pets that are under owners control at all times (dogs need to be on leashes)
may be brought to the picnic/common areas if they do not create a nuisance
to others. Owners are advised to leave pets home on busy weekends. Dogs
under owners control are allowed to swim in the lake by the dam area.
Owners need to do pooper-scoop patrol for their dogs. Owners need to keep
dogs on leashes when others are nearby or otherwise prevent them from
approaching other dogs/owners/guests. This policy is dependent on the full
cooperation of dog owners.
Wildlife:
Please do not feed the ducks &
other water fowl due to bacterial problems this may create for swimmers.
Feeding of wildlife other than songbirds is strongly discouraged.
Mistreatment of wildlife is strictly forbidden. Fish, frogs, and other water
life that are caught are to be quickly released unharmed. Children harming
wildlife may be required to be supervised when at the lake.
Motorized scooters/dirt
bikes/ATV use:
Motorized vehicles are not permitted for use on LMPHOA common property.
Vehicles used on streets must be licensed for such use. Users are not to
create a nuisance for their neighbors by passing back and forth repeatedly.
Green sticker vehicles need to be walked or appropriately transported to the
access points for legal use. Trespassing with these vehicles on private
property is strictly prohibited. Trespassing or other infractions may be
reported to the Calaveras County Sheriffs Department (795-0473 or 754-6500).
Non motorized vehicle Use:
Bicycles, scooters,
skates, skateboards are not to be used in the area surrounding the lodge.
This includes the shuffleboard courts and pier. Due to the inherent dangers
in their use, parental permission must be obtained and use of safety
equipment such as helmets is strongly advised. Use under these conditions is
allowed in the parking lot and basketball court areas when there is not a
conflict with other use and the activity can be conducted safely. Users must
comply with any instructions from staff about these activities.
Equipment Use:
Equipment may be checked out at
the Equipment Shed by providing a tag, signing for the item, and agreeing to
any specific use rules. Equipment is to be returned in good condition when
you are finished using it, and your tag will be returned. Equipment is
loaned out on a first come, first serve basis. Equipment is to be used for
the purpose for which it was intended, and in a safe manner. The costs for
the replacement of any equipment that is lost or damaged by inappropriate
use will be billed to the responsible property owner.
Swimming/Beach Use:
Children under 16 need to pass a swim test administered by an LMPHOA
lifeguard to swim beyond the roped area. Non-swimmers need to wear a life
jacket in the water or be supervised by an adult in close proximity at all
times. Individuals taking medications that cause drowsiness, or under the
influence of alcohol or drugs are not to go swimming. Swimming outside
the supervised area or after supervised hours is at your own risk.
Diapers or washing up is not allowed in the lake for sanitation reasons.
Children wearing diapers need to be washed and changed into 'little
swimmers' or close fitting plastic pants before entering the lake. Soap and
changing facilities are available in the bathrooms. For safety reasons, no
glass or fishing is allowed on the beach or dock areas.
Boat Use:
Boats are available on a first
come, first serve basis at the equipment shed. Boat safety rules are to be
reviewed and safety equipment used as directed. Minors may not check out
boats unless prior approval is obtained from the head life guard or
recreation supervisor. Boats are checked out and returned from the dock
area. Each person using a boat must have a seat available to him or her.
Jumping off of boats, standing up, roughhousing, or bumping into others is
not allowed. Each person must be wearing a life jacket that fits him or her
and is properly fastened. Those under the influence of alcohol or other
substances are prohibited from going out in LMPHOA boats. Boaters are to
follow the directions of the lifeguards, and to use the boats in a safe
manner away from swimmers. Boats are not to enter the roped off swimming
area.
Paddleboat users are to keep the
boats out of the reeds and algae growth, away from the shoreline and shallow
areas. Kayak users are limited to 30 minutes of use. Fishing is allowed only
from the LMPHOA rowboat and should be cleaned out after use. Private boat
owners are required to register yearly in the LMP Office, label their boat
with their lot number and lock securely to a tree, stored upside-down.
Please keep boat off the paths and away from the beach area. Private boat
users are expected to use their boats in a safe and considerate manner, and
are also to obey directions from the lifeguards regarding boat use.
Unlabeled boats or boats left on the path may be removed by LMPHOA staff.
Boats not used regularly should be stored at home. Motors of any king are
prohibited from use on the lake.
Fishing Policy:
LMPHOA has a catch and release policy. Fish or other water animals are to be
released unharmed and in a timely manner. Please contact the office if you
have any questions about this policy. Fishermen and women are to have an
LMPHOA ID tag or pass with them, a current state fishing license if over the
age of 16, and a current parking pass on display if using a vehicle. Fishing
should be done away from the swimming and dock areas. Fishermen and women
are required to remove all fishing line, tackle, hooks, and trash upon
leaving.
Court Use:
Court use is on a first come, first serve basis. Users are, however,
expected to attempt to include others, take turns, exercise good
sportsmanship, and play in a safe and responsible manner. Hanging on the
rims is prohibited as the rims are easily bent or damaged which may result
in the responsible property owner being charged for the costs of repair or
replacement. Non-basketball use is allowed in the absence of those
interested in playing basketball.
Lodge Use:
Reservations for lodge use must be
made by owners in advance through the office. Use of the grounds for group
use should also be reserved through the office to avoid use conflicts and
allow for staff planning and preparation. Group use of the lodge is limited
to 100 person maximum. LMPHOA property owners may use the lodge at no cost
when group size is limited to 15 and length of use is less than 4 hours. A
fee of $50 is charged for groups over 15 or use for more than 4 hours. Use
of the lodge is All renters are required to obtain a certificate of
insurance in the amount of $300,000 for liability. A cleaning/small damage
deposit is required prior to rental of $200, which will be returned minus
any cleaning or property repair/replacement costs. A small meeting room is
now available to members for groups of 15 or less - free by reservation
through the office.

Campfire/Nighttime Use:
Campfires are allowed only in
the established fire pit and only with prior approval by the office staff or
recreation supervisor. A name and contact information of a responsible adult
who will be present must be on file with the office. Campfire participants
must follow LMPHOA rules and their activities must not disturb the nearby
residents. The area must be left clean and water doused on the fire to put
it out. Roughhousing by a fire is prohibited. Participants use the campfire
at their own risk. Any users should observe the County curfew for minors of
10:30 p.m.
LMPHOA
staff, in collaboration with the LMPHOA Board of Directors, is committed to
the use of consequences that are nondiscriminatory, fair and consistent, and
appropriate to the level of the violation. Staff may offer the option of
'community service' such a picking up trash or pulling weeds in a designated
area to allow rule violators to restore their good standing and remain at
the lake. More serious violations and/or refusal to follow the direction of
the lifeguards may result in losing lake privileges for a specified period
of time. A law enforcement officer may be called if the violator refuses to
leave the area when told to do so by staff. In the case of chronic/serious
violations, a meeting may be required with LMPHOA staff and/or Board members
prior to resuming lake privileges. In the case of problems with minors, an
adult supervisor may be required to come to the lake with the minor. Serious
violations wherein a crime has been committed will be referred to law
enforcement. Lake privileges for the property owner may be suspended as
allowed for in the CC&R's. Written notice will be sent and the homeowner
will be given the opportunity to present their side of the issues and
concerns. The Board at the monthly meeting will review any written grievance
issues. Membership privileges will be reinstated with a satisfactory
resolution of the problem.
